(collectively the “Hua Yang Group”, and any of the companies within the Hua Yang Group shall be referred to as “Company”) collects, uses and protects the Personal Data of their customers and prospective customers, and such other persons whose Personal Data have been provided to the Group or the Company, including but not limited to, new job applicants. This Notice is prepared in accordance with the requirements of the Personal Data Protection Act, 2010.
1. PERSONAL DATA
1.1 The “Personal Data” that you provide or have provided to the Company includes your name, contact details, address, email address, NRIC number or passport number, gender, age, date of birth, job title, particulars of your spouse or family members, bank account details and any information which relates directly or indirectly to you, from which you may be identified or may be identifiable from that information, which is collected, recorded, held or stored by the Company.
1.2 In addition to the Personal Data that you provide to the Company directly (whether at the time of registering with the Company as interested buyer or at the time of purchasing any property sold by the Company), or at the time of submission of your job application to the Company, as the case may be), the Company may also collect your Personal Data from various other sources, including without limitation, from third parties through referral or lawful sources, the Group’s appointed property agents or at events organized or participated by the Company.
2. PURPOSE OF PROCESSING OF PERSONAL DATA
2.1 Your Personal Data will be used and processed by the Company and/or the Group for the purposes as described below:
(1) for preparing and executing all such instruments, documents and agreements necessary for purpose of entering into transactions with the Company, including without limitation, sale and purchase transactions;
(2) to enable the Company to carry out or perform any services or functions for the purposes of or in connection with paragraph (1) above;
(3) for registration as the Company’s list of customers or prospective customers;
(4) for the Company’s internal administrative purposes, including human resource administrative purposes (in relation to Personal Data of the new job applicants);
(5) for delivering important notices in relation to any changes of the Company’s terms, conditions or business/sale policies that may affect you;
(6) for the Company to communicate with you or contact you for all purposes set out above; and
(7) for the Company to comply with any legal or regulatory requirements relating to the Company’s provision of services and products under the requirements of any applicable laws, regulations, by-laws, guidelines, directions or any court order applicable to the Company or the Group.
2.2 It is voluntary for you to supply your Personal Data to the Company. However, if you do not provide your Personal Data, the Company may not be able to:
(1) carry out effectively the necessary agreements transacted with you such as sale and purchase agreements for sale of the Company’s property or product;
(2) provide you with the services that you requested from the Company;
(3) provide you with the notices or materials that you requested from the Company, if any; or
(4) communicate effectively with you.
The Company may also process your personal data for the purposes as follows:
(1) for delivery to you invites to the Group’s property launches and events; or
(2) for delivery to you promotional materials and advertisements for the Company’s marketing purposes.
(3) to contact you in the future for any career prospects purposes.
2.4 The Company shall communicate with you, for the purposes set out in paragraphs 2.1 and 2.3 above, either by way of email, SMS or ordinary mail.
2.5 If you do not agree to the Company processing your Personal Data for any of the purposes set out in paragraph 2.3, please notify the Company by contacting the Company via the contact details set out in paragraph 6.1 below.
3. DISCLOSURE OF PERSONAL DATA
3.1 Your Personal Data provided to the Company or obtained by the Company shall be kept confidential by the Company. However, it may be necessary for the Company to disclose and transfer your Personal Data to the following parties where required for the purposes for and in connection with paragraph 2.1:
(1) Lembaga Hasil Dalam Negeri;
(2) land office or land authority;
(3) banks and financial institutions;
(4) third party companies, entities or service providers engaged by the Company to perform certain services on the Company’s behalf, including the following:
- (a) insurance providers;
- (b) storage facility providers;
- (c) external advisors and other professional advisors, such as auditors and legal firms;
- (d) contractors or sub-contractors appointed by the Company.
(6) utility bodies;
(7) Ministry of Housing and Local Government; and
(8) third party property management companies in connection with property that you have purchased from the Company.
3.2 The Company shall also disclose and transfer the information to any relevant statutory bodies, regulatory bodies, local authorities and/or other governmental authorities where required, and any such person to whom the Company is required to do so pursuant to a direction or order of such statutory bodies, regulatory bodies, local authorities and/or other governmental authorities.
3.3 The Company may also disclose your Personal Data to other Company or companies within the Group where it is necessary or appropriate to enable the Company to provide its product or service to you, or and for purposes of data storage or processing.
4. EMAIL AND WEBSITE
4.1 Any Personal Data provided via your registration through the Company’s Website and Any Personal Data contained in the emails and ‘Contact Us’ messages sent via the Company’s Website to the Company shall be used and processed in the manner set out in this Notice. The content of the messages shall be strictly monitored by the Company.
4.2 If you do not wish for your Personal Data to be collected via cookies on the Website, please configure your internet browser to delete or deactivate cookies.
4.3 The Company’s Website may contain links to other sites and pages not owned by the Group. The Company shall not be responsible for any Personal Data or information that you may provide to other entity via such links.
5. SECURITY AND RETENTION OF PERSONAL DATA

6.1 We take reasonable steps to ensure that your Personal Data provided to us is accurate. (secara kolektif “Kumpulan Hua Yang”, dan mana-mana daripada syarikat-syarikat di bawah Kumpulan Hua Yang Group akan dirujuk kepada sebagai “Syarikat”) mengumpulkan, menggunakan dan melindungi Data Peribadi pelanggan-pelanggan dan bakal pelanggan mereka, dan orang-orang lain yang mana Data Peribadi telah diberikan kepada Kumpulan atau Syarikat, termasuk dan tidak terhad kepada pemohon-pemohon baru pekerjaan. Notis ini disediakan selaras dengan keperluan-keperluan Akta Perlindungan Data Peribadi, 2010.
1. DATA PERIBADI
1.1 “Data Peribadi” yang anda berikan atau telah diberikan kepada Syarikat termasuk nama, maklumat perhubungan, alamat, alamat e-mel, nombor kad pengenalan atau nombor pasport, jantina, umur, tarikh lahir, jawatan, butir-butir pasangan atau ahli-ahli keluarga, butir-butir akaun bank anda dan apa-apa maklumat yang berhubung secara langsung atau secara tidak langsung kepada anda, daripada yang mana anda boleh dikenal pasti atau dapat dicamkan daripada maklumat tersebut, yang mana dikumpulkan, direkodkan, dipegang atau disimpan oleh Syarikat.
1.2 Di samping Data Peribadi yang anda berikan kepada Syarikat secara langsung (sama ada ketika pendaftaran dengan Syarikat sebagai pembeli yang berminat atau pada masa pembelian sebarang hartanah yang dijual oleh Syarikat), atau pada masa pemberian permohonan pekerjaan kamu kepada syarikat, sepertimana kes yang mungkin) Syarikat juga boleh mengumpulkan Data Peribadi anda daripada pelbagai sumber-sumber lain, termasuk tanpa had, daripada pihak-pihak ketiga menerusi rujukan atau sumber-sumber yang sah, ejen-ejen hartanah Kumpulan yang dilantik atau di acara-acara yang diaturkan atau disertai oleh Syarikat.
2. TUJUAN MEMPROSES DATA PERIBADI
2.1 Data Peribadi anda akan digunakan dan diproseskan oleh Syarikat dan/atau Kumpulan bagi tujuan-tujuan sebagaimana yang dihuraikan di bawah:
(1) untuk menyediakan dan menguatkuasakan segala instrumen-instrumen, dokumen-dokumen dan perjanjian-perjanjian yang diperlukan bagi tujuan memasuki transaksi-transaksi dengan Syarikat, termasuk tanpa had, transaksi-transaksi jual dan beli;
(2) untuk membolehkan Syarikat menjalankan atau melaksanakan sebarang perkhidmatan-perkhidmatan atau fungsi-fungsi bagi tujuan atau yang berkaitan dengan perenggan (1) di atas;
(3) untuk pendaftaran sebagai senarai pelanggan-pelanggan atau bakalpelanggan Syarikat;
(4) untuk tujuan pentandbiran dalaman Syarikat, termasuk tujuan pentadbiran sumber manusia (berkenaan dengan Data Peribadi pemohon-pemohon pekerjaan baru);
(5) untuk penyampaian notis-notis penting berkenaan dengan perubahan di dalam terma-terma, syarat-syarat atau polisi-polisi perniagaan/penjualan Syarikat yang mungkin menjejaskan anda;
(6) untuk Syarikat berkomunikasi dengan anda atau menghubungi anda bagi semua tujuan-tujuan yang dinyatakan di atas; dan
(7) untuk Syarikat mematuhi dengan keperluan undang-undang atau peraturan berhubung dengan pemberian perkhidmatan-perkhidmatan dan produk-produk Syarikat di bawah keperluan undang-undang terpakai, peraturan-peraturan, undang-undang kecil, garis-garis panduan, arahan-arahan atau sebarang perintah mahkamah yang terpakai kepada Syarikat atau Kumpulan.
2.2 Ianya adalah sukarela bagi anda untuk membekalkan Data Peribadi anda kepada Syarikat. Walaubagaimanapun, jika anda tidak memberikan Data Peribadi anda, Syarikat mungkin dapat:
(1) menjalankan perjanjian-perjanjian yang perlu ditransaksikan dengan anda seumpama perjanjian-perjanjian jual dan beli bagi penjualan hartanah atau produk Syarikat secara efektif;
(2) memberikan anda perkhidmatan-perkhidmatan yang anda minta daripada Syarikat;
(3) memberikan anda notis-notis atau bahan-bahan yang anda minta daripada Syarikat, jika ada; atau
(4) berkomunikasi dengan anda secara efektif.
2.3 Syarikat juga boleh memproseskan Data Peribadi anda bagi tujuan-tujuan seperti berikut:
(1) untuk menyampaikan kepada anda jemputan-jemputan ke pelancaran-pelancaran hartanah dan acara-acara Kumpulan Hua Yang; atau
(2) untuk menyampaikan kepada anda bahan-bahan promosi dan iklan-iklan bagi tujuan pemasaran Syarikat.
(3) untuk menghubungi kamu pada masa hadapan bagi apa-apa tujuan prospek kerjaya.
2.4 Syarikat akan berkomunikasi dengan anda, bagi tujuan-tujuan yang dinyatakan di perenggan-perenggan 2.1 dan 2.3 di atas, sama ada menerusi e-mel, SMS atau pos biasa.
2.5 Jika anda tidak bersetuju untuk Syarikat memproseskan Data Peribadi anda bagi mana-mana tujuan yang dinyatakan di perenggan 2.3, sila maklumkan Syarikat dengan menghubungi Syarikat menerusi maklumat perhubungan yang dinyatakan perenggan 6.1 di bawah.
3. PENDEDAHAN DATA PERIBADI
3.1 Data Peribadi anda yang diberikan kepada Syarikat atau diperolehi oleh Syarikat akan disimpan secara rahsia oleh Syarikat. Walaubagaimanapun, ianya mungkin perlu bagi Syarikat untuk mendedahkan dan memindahkan Data Peribadi anda kepada pihak-pihak yang berikut, sekiranya perlu, bagi tujuan perenggan 2.1:
(1) Lembaga Hasil Dalam Negeri;
(2) pejabat tanah atau pihak berkuasa tanah;
(3) bank-bank dan institusi-institusi kewangan;
(4) syarikat-syarikat, entiti-entiti atau pembekal-pembekal perkhidmatan pihak ketiga yang diambil khidmat oleh Syarikat untuk melaksanakan perkhidmatan-perkhidmatan tertentu bagi pihak Syarikat, termasuk yang berikut:
- (a) pembekal-pembekal insurans;
- (b) pembekal-pembekal kemudahan tempat simpanan;
- (c) penasihat-penasihat luaran dan penasihat-penasihat profesional lain, seumpamanya juruaudit-juruaudit dan firma-firma guaman;
- (d) kontraktor-kontraktor atau sub-sub kontraktor yang dilantik oleh Syarikat.
(6) badan-badan utiliti;
(7) Kementerian Perumahan dan Kerajaan Tempatan; dan
(8) syarikat-syarikat pengurusan hartanah pihak ketiga yang berkaitan dengan hartanah yang anda telah membuat pembelian daripada Syarikat.
3.2 Syarikat juga akan mendedahkan dan memindahkan maklumat kepada mana-mana badan berkanun, badan pengawal selia, pihak-pihak berkuasa tempatan dan/atau pihak-pihak berkuasa kerajaan lain yang berkenaan di mana diperlukan, dan kepada mana-mana orang yang Syarikat dikehendaki untuk membuat demikian menurut satu arahan atau perintah badan berkanun, badan pengawal selia, pihak-pihak berkuasa tempatan dan/atau pihak-pihak berkuasa kerajaan lain tersebut.
3.3 Syarikat juga mungkin mendedahkan Data Peribadi anda kepada Syarikat atau syarikat-syarikat lain di bawah Kumpulan Hua Yang di mana ianya diperlukan atau adalah wajar bagi membolehkan Syarikat memberikan produk atau perkhidmatannya kepada anda, dan/atau bagi tujuan simpanan atau pemprosesan data.
4. E-MEL DAN LAMAN WEB
4.1 Sebarang Data Peribadi yang diberikan melalui pendaftaran anda menerusi Laman Web Syarikat dan sebarang Data Peribadi yang terkandung dalam e-mel dan pesanan ‘Hubungi Kami’ yang dihantar melalui laman web Syarikat kepada Syarikat akan digunakan dan diproseskan dengan cara yang dinyatakan dalam Notis ini. Kandungan pesanan-pesanan akan diawasi dengan ketat oleh Syarikat.
4.2 Jika anda tidak ingin bagi Data Peribadi anda dikumpulkan melalui cookies di Laman Web, sila konfigurasi pelayar internet anda untuk membatalkan atau menyahaktifkan cookies.

5. SECURITY AND RETENTION OF PERSONAL DATA
5.1 Data Peribadi anda yang diberikan kepada Syarikat atau diperolehi oleh Syarikat hendaklah disimpan dengan selamat oleh Syarikat menerusi langkah-langkah dan prosedur-prosedur pentadbiran dan keselamatan yang munasabah dan wajar untuk menghalang sebarang pemprosesan yang tidak dibenarkan atau menyalahi undang-undang, kehilangan atau kerosakan kepada, Data Peribadi anda.
5.2 Sebarang Data Peribadi yang diberikan oleh anda kepada Syarikat akan disimpan oleh Syarikat selagi tujuan-tujuan yang dinyatakan di perenggan-perenggan 2.1 dan/atau 2.3 di atas dikehendaki untuk dipenuhi, atau jika pemeliharaan sedemikian adalah perlu selaras dengan mana-mana keperluan-keperluan undang-undang, peraturan-peraturan atau perakaunan.
6. PERMINTAAN UNTUK AKSES DAN PERTANYAAN
6.1 Kami mengambil langkah-langkah yang munasabah bagi memastikan bahawa Data Peribadi anda yang diberikan kepada kami adalah tepat. Walaubagaimanapun, anda boleh pada bila-bila masa selepas ini meminta akses kepada, atau meminta untuk pembetulan atau pemindaan Data Peribadi anda, atau menghadkan pemprosesan Data Peribadi anda oleh Syarikat, mengikut mana yang berkenaan, namun adalah tertakluk kepada pengecualian-pengecualian dan sekatan-sekatan sebagaimana yang terkandung di bawah undang-undang terpakai. Syarikat mengekalkan hak untuk untuk meminda atau mengubah suai Notis ini dari masa ke semasa tanpa memberikan notis terlebih dahulu kepada anda.
8. KETIDAKSELARASAN
Sekiranya terdapat sebarang ketidakselarasan atau sebarang peruntukan yang tidak konsisten di antara Notis dalam Bahasa Inggeris dan Notis dalam Bahasa Melayu, Notis dalam Bahasa Inggeris adalah digunapakai.
